2. What weapons are prohibited for circulation in Russia?

According to the law "On Weapons", in the territory of the Russian Federation, in particular, the circulation as civilian and service weapons is prohibited:

  • long-barreled firearms with a magazine (drum) capacity of more than 10 rounds, with the exception of some types of sporting weapons;
  • firearms that are shaped to mimic other objects;
  • smooth-bore firearms made for cartridges for firearms with a rifled barrel;
  • brushes, brass knuckles, shurikens, boomerangs and similar items;
  • cartridges with armor-piercing, incendiary, explosive or tracer bullets, as well as cartridges with shot shells for gas pistols and revolvers;
  • gas weapons, equipped with nerve-paralytic, toxic, as well as other substances that are not allowed for use;
  • electroshock devices and spark gaps manufactured abroad or produced in Russia, but having output parameters exceeding the values ​​established by the state standard of the Russian Federation;
  • bladed weapons and knives, the blades and blades of which are either automatically removed from the handle when a button or lever is pressed and fixed by them, or advanced by gravity or accelerated movement and automatically fixed, with a blade and blade length of more than 90 millimeters;
  • civilian firearms of limited destruction with a muzzle energy of more than 91 joules and service firearms of limited destruction with a muzzle energy of more than 150 joules.

3. What are the fees for issuing licenses and permits?

In 2017, the fees for the issuance, renewal, reissuance of licenses for the acquisition and permits for the storage and carrying of weapons were replaced by state duties.

Now the fee for issuing a license to purchase weapons (except for gas weapons) is 2,000 rubles.

The fee for issuing and extending the period of validity of a permit to store and carry weapons is 500 rubles.

The fee for the issuance and renewal of a license for the purchase of gas weapons is 500 rubles.

The fee for reissuing any weapons license for the purchase, as well as any permit for the storage and carrying of weapons, is 250 rubles.

4. Who can't purchase weapons?

A license to purchase weapons is not issued to citizens of the Russian Federation who:

  • have not reached the age of 18 years (21 years in case of obtaining a license for weapons of limited destruction (colloquially - "injury");
  • they cannot provide a medical certificate and a medical report, which indicates that the doctors found either contraindications to possession of weapons or drugs in the body;
  • have an outstanding conviction for an intentional crime or have an expired conviction for a serious or special serious crime committed with the use of weapons;
  • serving a sentence for a crime committed;
  • twice a year brought to administrative responsibility for violations of public order, for violation of the rules of hunting, for violation of the rules for the circulation of narcotic or psychotropic substances;
  • do not have a permanent place of residence;

  • deprived by a court decision of the right to acquire weapons;
  • are registered with health care institutions for mental illness, alcoholism or drug addiction;

5. How to buy a gas weapon?

Gas weapons in Russia are sold for self-defense. Every citizen who has the right to purchase weapons has the right to own no more than five gas pistols or revolvers. You can buy them both individually and several units at once.

In order to acquire them, you will need to obtain a license to purchase a gas weapon, which in fact is both a permit to possess and carry a gas weapon. This right to own and carry gas weapons is somewhat easier to obtain than other types of weapons. Indeed, in the case of pneumatic, smooth-bore and rifled weapons, as well as weapons of limited destruction, these are two different documents that are drawn up sequentially.

6. How to buy weapons of limited destruction?

Weapons of Limited Destruction (better known as traumatic weapon) in Russia is sold for self-defense. Every citizen who has the right to purchase weapons has the right to own no more than two units of firearms of limited destruction (traumatic weapons). You can buy them individually or both at the same time.

It is important to know that when obtaining a license for a smoothbore weapon for self-defense, you will not be able to obtain permission to carry such weapons - only for storage, because it is understood that you will use it to protect your home. But hunters and athletes can purchase weapons and then get the right not only to store, but also to carry - after all, it is assumed that the former will use weapons for hunting, and the latter for training and competitions.

Anyone who has the right to purchase weapons can own no more than five smoothbore and an unlimited number of airguns.

Melee weapons can be purchased if you have two documents: a hunting license and a permit to store and carry hunting weapons - smoothbore, rifled or pneumatic. Medical certificates and checks

There are, in principle, three of them: psycho-neurological, narcological and from the clinic at your place of residence. The first, psycho-neurological, is obtained by you in the dispensary of the same name, and is called a “weapon certificate”. The process of obtaining a document from a narcological dispensary is exactly the same - show your passport, military ID, pay a fee. You receive certificates "for weapons" if you are not registered in these dispensaries.

But in the clinic it's a little different. You will need a medical examination, the purpose of which is the certificate "046-1". The certificate will tell you that you have no contraindications that could prevent you from properly using or handling a weapon. Examinations are carried out by an ophthalmologist, psychotherapist, narcologist, therapist.

Conditions

The purpose of a traumatic weapon is to block the commission of aggressive, dangerous and illegal actions, but it is designed for non-lethal defeat of both people and animals.

  • firearms civilian six-barreled gun;
  • limited firearms;

In order to have the right to use a weapon if necessary, a citizen must obtain a license for a traumatic weapon. The corresponding permit is issued by the licensing and permitting department at the place of registration of the citizen. They do not have the right to obtain permission to use and store traumatism of a person:

  • under the age of majority;
  • having a criminal record for a deliberate violation of the norms of the Russian Federation;

  • who do not have a permanent residence permit;

How to get a?

As previously noted, permission to use a traumatic pistol is issued in the management of licensing and permitting work. You need to contact the branch that belongs to the place of residence by registration. To obtain the appropriate document, a citizen must adhere to a certain procedure.

The acquisition process consists of the following steps:

  • it is required to undergo a special medical examination at the clinic, which must issue a certificate forms 046-1 . It should contain the seals of a neurologist and a narcologist confirming your psychological state. It is also necessary to visit an ophthalmologist, since in order to receive a traumatic weapon, one eye must see no worse than 0.5, and the other no worse than 0.2;
  • further, an application is submitted to the HRRR department together with a package of documents, a list of which will be presented below;
  • after submitting the application, the citizen will have to undergo mandatory training in the safe handling of weapons. At the end of the training, the person concerned will be required to complete a 10-question test, the results of which will be sent to the Licensing Department;
  • after passing the test, the citizen will have a personal conversation with the district police officer, who will inspect the residential premises by registration.   • further, in any branch of the bank, a state fee in the amount of 300 rubles is paid;

Required documents

An application for issuing a permit for the use and storage of traumatic weapons is submitted to a special police department at the place of registration of the address. The document is drawn up in the name of the head of the department and is considered within 10 working days, after which you will receive a written notification.

The application must be accompanied by:

  • a photocopy of the passport;
  • 2 photos of size 3 by 4;
  • certificate from medical institution forms 046-1;
  • a certificate confirming the completion of courses on the storage and use of traumatic weapons;
  • receipt of payment of the fee;
  • a signed report from the district police officer, which will prove that all conditions for storing the pistol are met.

Validity

The license for the storage and use of traumatic weapons will be valid for 5 years. After the expiration of the appropriate period, the citizen will need to go through the procedure for extending the document.

Permission to carry and use traumatics allows each person to purchase up to five weapons of traumatic use. If a document is stolen or lost, no citizen will have the authority to use it. The license contains all the information regarding its owner, as well as the official place of his residence.

Requirements for storage and use

Responsibility for violation of the rules of storage and use is regulated Code of the Russian Federation on Administrative Offenses , as well as the Criminal Code of the Russian Federation. How to renew a license to carry a traumatic weapon?

You can renew a license for a traumatic weapon in the following cases:

  • if three months before the expiration of its validity, an application was submitted to the LRO department;
  • if the application was accompanied by a photocopy of the identity card of the address, a repeated medical certificate and photographs 3×4 for each traumatic pistol;
  • if a certificate of successful completion of repeated training in the use of weapons was provided;
  • if a report was handed over to the district police that the conditions for storing weapons have never been violated on your part.

The right to renew the license will also be considered within 10 working days from the date of application. If after the expiration this period you will receive a written notification of the positive decision of the head of the LRO to renew the license for the use and storage of traumatic weapons, the document will also be valid for 5 years.

Lack of permission

The provisions of article 222 of the Criminal Code of the Russian Federation provide for the following types of punishment for possession of a pistol without permission:

  • imprisonment up to 3 years;
  • arrest of a citizen for 6 months;
  • imprisonment up to 4 years and a fine in the amount of 80,000 thousand rubles (the amount can also be calculated in accordance with the 3-month salary convict);
  • public forced labor within 4 years.

If the storage of traumatic weapons without a license was carried out by a whole group of persons, the criminal liability is toughened: imprisonment up to 6 years and a fine of up to 100,000 rubles. Also, at the legislative level, punishment is provided for organized groups that are engaged in illegal storage and sale of traumatic weapons - imprisonment up to 8 years and a fine of up to 200,000 rubles. The absence of a permit for the storage and use of traumatic weapons always entails criminal punishment, the degree of responsibility will depend on additional factors.
